Notice: Please read these Conditions carefully.
These Conditions set out the terms under which the Site, together with its content, search facilities, services, members` areas and vacancies section and other internet services provided by Scottish Renewables Forum Limited (Scottish Renewables hereinafter referred to as "SR") from time to time, is made available to the User.
These Conditions apply to SR members and Users of the Site and by accessing the SR site, whether as a SR member or visitor, the User agrees to be bound by these Conditions.
The User should refrain from using the Site if the User does not agree with these Conditions.
In these Conditions, unless the context otherwise requires:
“Members’ Areas” means any part of the Site which states it is reserved for the use of members of SR;
“Site” means the website owned, operated and maintained by or on behalf of SR, identified by the URL "http://www.scottishrenewables.com";
“SR” means Scottish Renewables Forum Limited, Scottish company number SC200074, having its registered office at c/o Harper Macleod LLP, The Ca'd'oro, 45 Gordon Street, Glasgow, G1 3PE;
“User” means any person accessing, viewing, downloading, or using the Site or any part of the Site; and
“Vacancies Section” means that part of the Site on which Users can post vacancies
Any reference to the singular includes the plural and vice versa, and any reference to one gender includes all other genders.
2. Application of these Conditions
By accessing or using any part of the Site, the User agrees to be bound by these Conditions to the exclusion of any conditions which the User may attempt to introduce.
3. Changes to these Conditions
SR may change these Conditions at any time without any notice to the User. By the User’s continued access and use of the Site, the User agrees to check these Conditions regularly for any changes that have been made. SR will only inform the User of changes to these Conditions where it is required to do so by law.
Access to the Site is permitted on a temporary basis, and SR reserves the right to withdraw or amend the services and the material made available upon or through the Site without notice. Material includes any material SR provides to the User resulting from the User’s use of the services.
SR reserves the right to restrict, at SR’s sole discretion, access to some parts or all of the Site.
The User is responsible for making all arrangements necessary for the User to have access to the Site.
The User is also responsible for ensuring that all persons who access the Site through any facilities provided by the User or over which the User has control are aware of these Conditions, and that they comply with them.
By accessing the Site, the User warrants that he or she is legally capable of entering into binding contracts and that he or she is over eighteen (18) years of age.
By accessing the Site, the User warrants that he or she will comply with all applicable laws and regulations of the country from where he or she accesses the Site. The User agrees to indemnify SR against all liability for any damages, loss, costs, expenses or other liability relating to or arising out of the User’s failure to comply with any such laws and regulations.
The Site is protected by worldwide copyright laws and treaties. Copyright in the pages of the Site, in the screens displaying the pages and in the information and material contained therein and their arrangement, together with the domain name `scottishrenewables.com` is owned by or licensed to SR, unless otherwise indicated.
Other than as explicitly specified hereunder, nothing in these Conditions should be construed as granting by implication, estoppel, personal bar or otherwise any licence or right to use the Site or any material without SR’s permission.
Permission is granted for the User’s use of copyright material exclusively for the limited purposes of:
- printing one hard copy of portions of the content of the Site for maintaining the User’s own personal records, study research or internal business purposes;
- downloading the pages of the Site for viewing in a compatible web browser;
- storing the pages of the Site in a cache or other temporary retrieval system for the sole purpose of personal viewing off-line; and
- drawing the attention of third parties to material generally and publicly made available on the Site.
Any other use, modification, adaptation, derivation, extraction, reorganisation, distribution or re-publication without the prior written consent of SR is similarly strictly prohibited.
Any User wishing to use the copyright material for other purposes must first contact SR for permission at firstname.lastname@example.org. In the event of any such use being permitted, SR’s status as the author of material contained on the Site must always be acknowledged.
Links are permitted to the home page of the Site only and not to any other pages of the Site from a website owned or operated by the User. Linking or framing to the Site is permitted only with the prior written consent of SR- please contact SR at email@example.com. Where the Site provides a link to any other website operated by another party, SR makes no endorsement of that other website, and SR accepts no liability whatsoever for any information which is accessed through any links to websites operated by other parties.
The User must not establish, nor procure that any third party establishes, a link to the Site in such a way as to suggest any form of association, approval or endorsement by the User or any entity which the User represents by SR without SR’s explicit prior written consent.
The User must not establish, nor procure that any third party establishes, a link from any website that is not owned by the User.
The User must not establish, nor procure that any third party establishes, a link to any page upon the Site other than the Site’s home page.
The User must not frame, nor procure that any third party frames, the Site on any other website.
The User must not stream or aggregate content from the Site within another website nor procure that any third party undertakes such activities.
SR reserves the right to withdraw its permission to link to the Site without notice and for whatever reason as SR may in its sole discretion determine.
Where the Site contains a link to a site or resource provided by a third party, such a link is provided for the purposes of information and convenience only. The provision by SR of a link to a third party site does not represent any endorsement or recommendation by SR in respect of that third party site and does not mean that SR has any association with that third party site. SR has no control over the contents of third party sites.
SR excludes all liability for any damages, loss, costs, expenses or other liability arising out of any use of or interaction with third party sites.
7. Intended users
The Site is intended for use by: (1) members and associate members of SR; and (2) non-members with an interest in renewable energy issues.
SR reserves the right to verify independently any User’s details and to refuse access to the Site at any time and to refuse or cancel the registration of any User without notice at its own discretion and without liability in relation to the cancellation and the consequences thereof.
The material contained in the Site (including without limitation any information posted to the Members’ Areas or Vacancies Section) is presented for information purposes only and is intended to be used as an information resource only. No warranty is offered or is to be implied as to the suitability and appropriateness of any information sourced through the Site.
SR shall use reasonable endeavours to ensure that the Site is available and operates properly at all times. However, to the fullest extent permitted by law, neither SR nor any of its officers, directors, shareholders, employees, affiliates, agents, third-party content providers, sponsors, licensors, or the like, makes any representation or warranty or condition, either express or implied, to the User:
- that the Site will be uninterrupted or error-free;
- that the Site or the computer server from which the Site is made available or operational, are free of viruses, trojans or other harmful components; or
- to the accuracy, content, timeliness, completeness, legality, reliability, quality or suitability of any information, advice, content, service, results, products or merchandise provided through the Site.
- SR makes and the User accepts, no representations, warranties or conditions, express or implied, statutory or otherwise with respect to:
- the Site, its content, merchandise, services, documents, information, items or materials provided by SR in connection with the use of the Site; or
- any goods or services or information received through or advertised on the Site or received through links provided on the Site
Including without limitation no representations, warranties or conditions of merchantability, suitability, fitness for a particular purpose, non-infringement of proprietary rights or otherwise.
No oral advice or written information given by SR, or any of its officers, directors, employees, agents, providers, merchants, sponsors, licensers, or the like, will create a representation, a warranty or condition nor shall any User be entitled to rely on any such information or advice.
In jurisdictions that do not allow the exclusion or disclaimer of certain warranties, the above exclusion may not apply to some Users.
SR is not an agent for and does not vouch for those persons, companies and other organisations whose goods or services may be displayed or referred to in the Site, nor for the availability, suitability or prices of such goods and services nor for the legal entitlement, competences, professional qualifications, trade certifications, or memberships of trade associations of such persons, companies or other organisations.
SR advises Users to satisfy themselves as to the exact type and nature of goods or services being offered or qualifications held by those persons, companies and other organisations whose goods or services may be displayed or referred to in the Site.
The Site may make available certain information provided by third parties. SR recommends that before any User uses any such information with respect to any issues or questions that the User may have relating to any professional or technical issue, the User seeks advice from a qualified professional.
8. Limitation of Liability
Neither SR nor its associated content-provider organisations seek to limit or exclude liability for death or personal injury arising from their negligence.
Subject to the above, under no circumstances will SR or any of its officers, directors, shareholders, employees, affiliates, agents, sponsors, licensers, or any other party involved in the creation, production, maintenance or distribution of the Site be liable to the fullest extent permitted by law to any Users or to any third party to whom Users have provided information contained on the Site for any direct, indirect, incidental, special or consequential damages (including but not limited to loss of profits, business, anticipated savings, goodwill, use of data or other intangible losses) that result from either:
- the use and reliance on the Site; or
- the inability to use the Site; or
- mistakes, omissions, interruptions, suspension, termination, deletion of files or email, errors, defects, viruses, delays in operation, transmission or service response time, or any failure of performance with respect to the Site including without limitation those arising from acts of God, communications failure, theft, destruction or unauthorised access to SR’s records, programs or services; or
- merchandise, products or services received through or advertised on the Site and merchandise, products or services received through or advertised on any links provided on the Site; or
- information, results or advice received through or advertised on the Site and information, results or advice received through or advertised on any links provided on the Site; or
- any information, data, text, messages and other materials emailed, posted, uploaded, reproduced, transmitted or otherwise distributed using the Site.
If a User or any third party to whom a User provides any material or any information concerning any services or material on the Site requires to rely on any part of the services or material or any information concerning any services or material, the User undertakes to seek advice from an independent professional experienced and practising in the relevant field, and to advise any such third party to do the same.
SR is unable to ensure or guarantee the security of any information transmitted over the internet. Any information or data transmitted to or by a User using the Site is done at the User’s own risk and SR shall not be responsible or liable for any damages or injury that may result from transmitting such information.
If any jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, liability is limited to the fullest extent permitted by law.
Viruses, hacking and other offences
A User must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
A User must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.
A User must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, a User would commit a criminal offence under the Computer Misuse Act 1990.
If a User breaches this clause, SR has the right to report any such breach to the relevant law enforcement authorities and SR will co-operate with those authorities by disclosing the User’s identity to them. In the event of such a breach, the User’s right to use the Site will cease immediately.
SR excludes all liability for any damages, loss, costs, expenses or other liability arising out of or relating to any distributed denial-of-service attack, viruses or other technologically harmful material that may infect computer equipment, computer programs, data or other proprietary material due to use of or access to the Site, any services or material, or the use of or interaction with any third party site.
9. Vacancies Section
In order to access the Vacancies’ Section of the Site, Users will be provided with a user name and password. Users must treat such information as confidential and must not disclose it to any third party.
SR reserves the right to disable any user name and password or any other piece of information enabling access to the Site at any time for such reason as SR may, in its sole discretion, determine, including, without limitation, if in SR’s opinion, the User has failed to comply with any of the provisions of these Conditions.
The views and opinions expressed in the Vacancies Section are those of the contributing Users and not SR. The views and opinions expressed by SR in responses made by it or on its behalf in the Vacancies Section are subject to the Disclaimers section and the Limitation of Liability section (see above). SR shall not be held responsible in any way whatsoever for the contents of the Vacancies Section.
If any User finds any of the contents of the Site inappropriate, they should inform SR forthwith.
The User undertakes to SR that when viewing, using or contributing to the Members’ Areas or Vacancies Section, the User shall:
- not post on the Vacancies Section, or otherwise transmit to any other User or to SR, any information, data, viruses, files, graphics, links or other materials which are illegal, harmful, threatening, abusive, defamatory, obscene, discriminatory or otherwise may be deemed undesirable by SR;
- not impersonate, threaten, harass or cause any discomfort or distress to any other User or any other person;
- except as expressly permitted by SR, not post on the Vacancies Section, or otherwise transmit to any other User or to SR, any promotional, marketing or advertising material, or otherwise solicit the custom of any other User through the Members’ Areas or Vacancies Section; and
- promptly and fully comply in all respects with all applicable local, regional, national and international laws applicable to the User’s conduct and the User’s use of the Vacancies Section and the Site.
- SR reserves the right to remove from the Vacancies Section any material which it deems, in its absolute discretion, inappropriate or which may bring SR into disrepute, including (but without limitation) material of a pornographic, defamatory, illegal or otherwise offensive nature.
No material that is found on the Vacancies Areas that is of an inappropriate, pornographic, defamatory, illegal or otherwise offensive nature may be copied from the Site or distributed or published in any way.
By making any contribution to the Vacancies Section, the User shall be deemed to have granted to SR an irrevocable world-wide royalty free licence of the copyright in that contribution, to distribute that contribution and the User thereby undertakes that unless otherwise stated such contribution is the original unrestricted work of the User and shall not infringe any right of any third party.
10. Privacy and Data Protection
If the User submits to SR or the Site (including without limitation the Members’ Areas or Vacancies Section) any personal information which concerns or identifies a third party then the User warrants to SR that the user has obtained the proper informed consent of that third party for the purposes of the Data Protection Act 1998.
The User agrees to indemnify SR fully and keep SR fully indemnified against any and all loss, damage, injury, costs, claims and expenses whatsoever incurred by SR and arising from the User’s contribution to and use of the Site.
Governing law and Jurisdiction
These Conditions and all transactions conducted through the Site shall be governed by the law of Scotland, and the User and SR agree to submit to the non-exclusive jurisdiction of the Scottish Courts.
